Carriers Should Actually “Adjust” Losses Before Forcing Policyholders Into Appraisal
After I presented my client’s scope of a repair, a desk adjuster told me that any differences would have to be “resolved through appraisal,” but would not identify his position with respect to these differences. The problem with this is that there actually has to be a “dispute” as to the amount of loss before either side can properly invoke appraisal. The consequence is that the insurer is forcing the insured to incur the time and cost of appraisal without actually attempting to “adjust” the loss. In other words, this is another example of carriers attempting to shift risk back to their policyholders.
